Equine Dispute Resolution is a service of Frank Becker Legal
Services, LLC. Frank is an experienced equine attorney, arbitrator and mediator
committed to providing a means of efficiently and effectively resolving disputes
that arise concerning horses and the horse business.
EqDR provides arbitration or mediation to resolve disputes out of
court. Arbitration and mediation save the parties the time,
expense and emotional drain of a protracted and often unsatisfactory court
battle. EqDR provides a flexible and fair method of resolving disputes that
would otherwise grind through an overloaded legal system not designed to handle
equine-related disputes with efficiency or with expertise in horse-related
matters.
What Services Are Provided by EqDR?
EqDR provides both arbitration and mediation
services.
Arbitration
is the process where the EqDR neutral arbitrator makes a binding decision to
resolve a dispute. The arbitrator conducts a hearing in which each side presents
his or her case, and the arbitrator makes a decision based on the evidence and
arguments presented. The decision is binding on both parties, and is enforceable
under state and federal law should one side not comply.
Mediation
is different. In mediation, the EqDR neutral mediator assists the parties in
settling a dispute. Through an informal procedure, the mediator attempts to
clarify the issues and assist with establishing a dialogue between the parties
in an effort to arrive at a settlement of the controversy without the necessity
of going to court. The mediator does not make a decision about the case, but
assists the parties in reaching a settlement. A binding agreement is reached
only with the consent of both parties.
What Is Equine Dispute Resolution?
EqDR is a dispute resolution firm based in Lexington, Kentucky and is
managed by
Frank Becker, an experienced equine lawyer, mediator, and arbitrator. Frank has
been in the private practice of law for 25 years, and has been prominent in the
representation of clients involved in the horse business. Frank regularly speaks
at the National Conference on Equine Law, the nation’s most prominent and
prestigious seminar for equine lawyers. Frank is an experienced arbitrator and a
member of the National Panel of Commercial Arbitrators of the American
Arbitration Association. Frank is also a trained mediator, and is the former
Chair of the Mediation Center of Kentucky. Frank graduated from the University
of Kentucky College of Law in 1979, where he ranked first in his graduating
class, served on the Kentucky Law Journal, and was elected to the Order of the
Coif. Frank practiced with the Lexington-based firm of Miller, Griffin & Marks
and with the Lexington office of the prominent Cincinnati-based regional law firm of Dinsmore & Shohl.
Frank serves as the chief arbitrator and mediator for EqDR.
However, with the client’s permission, Frank will engage the services of other
reputable and experienced equine attorneys, mediators and arbitrators to handle
particular disputes.
